Welcome to MultiList. These Terms of Service ("Terms") govern your access to and use of the MultiList website, waitlist, educational resources, community, software, and any related services that MultiList makes available. By accessing or using our currently available services, you agree to the provisions of these Terms applicable to those services. If you do not agree, you must discontinue use.

Important Notice Regarding Software Launch

MultiList's software and certain automation features are currently in development and have not yet been publicly launched. The provisions of these Terms relating specifically to software functionality, unauthorized automation, marketplace account restrictions, account bans, software performance, and third-party integrations are included in advance for transparency. These software-specific provisions will become applicable to users when the relevant MultiList software or features are officially made available and the user accesses, activates, or uses them, subject to their acceptance of the Terms then in effect. Until then, the provisions concerning the website, waitlist, communications, educational resources, community, and other currently available services apply as relevant. MultiList may require users to review and expressly accept updated software-specific terms before accessing or activating the software.

1. About MultiList

MultiList is currently in development. Certain features described in these Terms may not yet be available. The availability, functionality, pricing, and release dates of future products have not been finalized. Provisions concerning unreleased functionality are provided to describe the conditions expected to apply when those services become available. They do not indicate that such functionality is currently operational.

Joining the waitlist does not create a purchase agreement or guarantee access to any particular product, feature, or price.

You may unsubscribe from marketing emails at any time using the unsubscribe link provided in those messages or by contacting us. If you separately choose to enroll in MultiList's SMS messaging program, you consent to receive recurring text messages from MultiList at the mobile phone number you provide. SMS participation is optional and separate from email subscriptions. MultiList will not sell, rent, transfer, or share SMS opt-in information or consent with third parties for their own marketing purposes. SMS consent information will be used only as permitted by applicable law and messaging requirements. The SMS messaging program will become available only after the necessary messaging infrastructure and approvals have been established.

5. The Free Course and Educational Resources

MultiList may provide free educational courses, community discussions, and informational resources concerning online reselling and business development. These resources are provided for general educational purposes only. We do not guarantee any particular financial result, sales volume, profit, business growth, or level of success. Individual outcomes depend on experience, effort, resources, market conditions, and business decisions. Any examples of revenue, earnings, or business performance do not represent guaranteed or typical results. Users are responsible for independently evaluating information before making financial or business decisions.

6. Community Guidelines

Users participating in MultiList-related communities must behave respectfully and comply with applicable community platform rules. Prohibited conduct includes: - Harassment, threats, or abusive behavior. - Fraud, scams, or deceptive business practices. - Sharing another person's private information without authorization. - Posting malicious links, spam, or harmful content. - Impersonating other individuals or organizations. - Using community resources for unlawful activities. We may moderate community participation, remove content, or restrict access when reasonably necessary. Communities hosted on third-party platforms may also be governed by those platforms' terms and privacy policies.

7. Acceptable Use

You agree not to misuse the MultiList website, software, or related services. You may not: - Attempt to gain unauthorized access to our systems or other users' accounts. - Introduce malware or harmful code. - Interfere with the security or operation of our services. - Use our services for fraud or unlawful conduct. - Circumvent MultiList's security systems or abuse our registration processes. - Misrepresent your identity or provide deliberately misleading registration information. You are responsible for complying with applicable laws and the rules of any third-party platforms you use. Nothing in these Terms authorizes conduct prohibited by third-party platforms. Provisions specifically concerning the use of MultiList's software apply when that software becomes available and is used.

8. Independence From Depop and Other Platforms

MultiList is an independent third-party software project. MultiList is not affiliated with, endorsed by, sponsored by, authorized by, or officially partnered with Depop, unless we expressly announce otherwise following written authorization. Depop is a trademark of its respective owner. References to Depop and other marketplaces are used solely to identify the platforms that our software is designed or planned to interact with. MultiList does not control Depop or any other third-party marketplace. Third-party platforms maintain their own rules, policies, security systems, and enforcement procedures. This independence disclosure applies immediately. Provisions relating to the actual operation of MultiList's software apply when that software becomes available.

9. Unauthorized Automation and API Disclosure

IMPORTANT: THE FOLLOWING SOFTWARE-SPECIFIC PROVISIONS WILL APPLY WHEN MULTILIST'S AUTOMATION SOFTWARE IS RELEASED AND USERS CHOOSE TO ACCESS OR USE THE RELEVANT FEATURES. MultiList intends to offer automated functions that interact with Depop and potentially other third-party marketplaces. Unless explicitly stated otherwise, MultiList's planned Depop automation features are not officially approved or authorized through Depop's partner API. Depop's Terms of Service restrict the use of bots and other unauthorized third-party software on its service. Accordingly, using certain MultiList features may violate Depop's Terms of Service or other applicable marketplace policies. Upon activation or use of the relevant software features, users expressly acknowledge and understand that: - MultiList is not an officially authorized Depop automation provider. - Some automation functions may conflict with Depop's rules. - Using unauthorized automation may result in warnings, account restrictions, temporary suspension, or permanent account termination. - Depop may restrict marketplace functionality, remove listings, or limit account access. - Account enforcement decisions are made by Depop, not MultiList. - MultiList cannot guarantee that its software will remain compatible with Depop. - MultiList does not guarantee that use of its software will go undetected or avoid enforcement. - Marketplace rules and enforcement practices may change without notice. By choosing to enable or use MultiList automation features after release, users acknowledge these disclosed risks and voluntarily decide whether to proceed. Users should not use a particular feature if doing so would violate an applicable platform rule. Nothing in this section grants authorization to violate third-party agreements or applicable law.

10. Account Suspension, Bans, and Termination

This section applies to the use of MultiList's software and marketplace automation features once those features become available. It does not imply that such features are currently released. To the maximum extent permitted by applicable law, MultiList disclaims liability for account restrictions or enforcement actions independently imposed by Depop or another third-party marketplace in response to a user's use of unauthorized automation. These consequences may include: - Temporary or permanent account bans. - Account suspension or termination. - Removal, restriction, or reduced visibility of listings. - Loss of access to marketplace features. - Interruption of sales activity. - Loss of sales opportunities or anticipated profits. - Marketplace investigations or verification requirements. - Other restrictions imposed under marketplace policies. Users acknowledge that using third-party automation involves risks that may affect their marketplace accounts and business operations. MultiList does not guarantee that an account will remain active, unrestricted, or in good standing while using its software. To the maximum extent permitted by applicable law, MultiList will not be responsible for losses arising solely from a third-party marketplace's independent enforcement of its rules against unauthorized automation. This provision does not exclude liability arising from MultiList's own conduct where such liability cannot lawfully be excluded, including applicable claims involving fraud, intentional misconduct, gross negligence, or statutory violations. Nothing in these Terms prevents users from exercising rights or pursuing remedies that cannot legally be waived.

11. User Responsibility and Control

This section's software-specific responsibilities apply when MultiList's software launches and users access or activate its functionality. Users are responsible for reviewing the rules applicable to their marketplace accounts before enabling automated features. Users are also responsible for: - Selecting and configuring automation settings. - Reviewing the actions they authorize. - Determining whether particular features are appropriate for their accounts. - Monitoring marketplace activity. - Disabling features they no longer wish to use. - Complying with applicable laws and marketplace policies. Where MultiList provides user-configurable settings, users are responsible for the selections they make. However, this does not eliminate any legal responsibility MultiList may have for defective software, security failures, misleading representations, or other conduct for which liability cannot lawfully be excluded.

12. Third-Party Compatibility and Service Interruptions

The provisions of this section concerning software integrations and marketplace compatibility apply when those functions become available. MultiList may depend on third-party websites, browser functionality, technical interfaces, and marketplace systems. These external systems may change without notice. As a result, MultiList features may stop functioning, become unreliable, or require modification. We do not guarantee permanent compatibility with Depop or other platforms. MultiList may modify, suspend, or discontinue affected features when necessary for technical, security, operational, or compliance reasons. We do not guarantee continuous access, uninterrupted service, or error-free automation. These statements apply to future software functionality only when made available. General website availability remains subject to Section 16.

13. Software Performance and Automation Errors

This section will become applicable to users when MultiList releases software functionality and they choose to use it. Automated software may occasionally behave unexpectedly, fail to complete actions, or produce unintended results. Potential issues include listing errors, incorrect updates, duplicate actions, interrupted processes, or changes that require manual correction. Users should review important marketplace activity and maintain their own records where appropriate. To the extent permitted by applicable law, MultiList does not guarantee that automated actions will always be completed accurately, successfully, or without interruption. This disclaimer does not remove liability that cannot legally be excluded.

14. Intellectual Property

Unless otherwise stated, the MultiList name, original branding, website design, graphics, written content, and other original materials are owned by or licensed to the operator of MultiList. You may not reproduce, distribute, sell, or commercially exploit protected MultiList materials without authorization, except where permitted by applicable law. Third-party names, logos, and trademarks remain the property of their respective owners. Nothing in these Terms transfers ownership of intellectual property to users. These provisions apply to currently available materials and to future MultiList materials when made available.

15. Privacy and Personal Information

Your use of MultiList is also governed by our separate Privacy Policy. The Privacy Policy explains how we collect, use, store, and disclose personal information. Information collected through the waitlist may include your name, email address, and, if voluntarily provided, your phone number. We may use third-party service providers to support website hosting, communications, security, and other operations. Please review our Privacy Policy for information about data handling and available privacy rights. Any additional collection or processing of personal information associated with future software functionality will be addressed in the Privacy Policy applicable when that functionality launches.

16. Availability and Changes to Services

We may update, modify, suspend, or discontinue portions of our website, software, or other services as MultiList develops. We do not guarantee uninterrupted availability, continuous uptime, or error-free operation. Certain features may become unavailable because of maintenance, technical problems, third-party restrictions, or other circumstances. Provisions concerning unreleased software functions apply only when those functions become available. Additional terms may apply to future paid subscriptions.

17. Disclaimer of Warranties

To the maximum extent permitted by applicable law, MultiList's currently available website, educational resources, and related services are provided on an "as is" and "as available" basis. Upon the launch of MultiList's software, the following software-specific disclaimers will also apply to users accessing or using that software, subject to the Terms accepted at that time. MultiList makes no guarantee that its services will be uninterrupted, error-free, continuously compatible with third-party marketplaces, or suitable for a particular business purpose. MultiList does not warrant that use of its software will prevent account restrictions, avoid marketplace enforcement, or produce specific financial results. Nothing in this section excludes warranties or consumer protections that cannot lawfully be excluded.

18. Limitation of Liability

To the maximum extent permitted by applicable law, MultiList and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of its services, including lost profits, lost business opportunities, or interruptions to marketplace activity, where such limitations are legally enforceable. When MultiList's automation software launches, the following additional software-specific limitation will apply to users who access or use the relevant functionality: MultiList does not assume responsibility for third-party marketplace enforcement decisions made independently by Depop or other platforms because users have engaged in prohibited or unauthorized automation. Users acknowledge that account restrictions, suspensions, terminations, and lost marketplace opportunities are potential consequences of using unauthorized automation. These limitations apply only to the extent permitted by applicable law. Nothing in these Terms excludes or restricts liability for fraud, willful misconduct, gross negligence, statutory violations, or other matters where such limitations are legally prohibited. No provision of these Terms eliminates rights or remedies that applicable law does not permit users to waive.

19. Eligibility

You must be legally permitted to access and use MultiList's services. If you are under the age of majority in your jurisdiction, you should review these Terms with a parent or legal guardian and obtain any required permission. Certain future features, paid subscriptions, or third-party services may carry additional eligibility requirements. The availability of a feature does not override age restrictions imposed by third-party marketplaces or payment providers.

20. Changes to These Terms

We may revise these Terms to reflect changes in our services, operations, or legal obligations. When updates are made, we will revise the "Last updated" date. For material changes, we will provide additional notice where required by law. Updated Terms apply prospectively, subject to applicable law, and do not retroactively eliminate rights that users already possess. If you disagree with updated Terms, you should stop using the affected services. Before MultiList's software launches, we may publish additional or revised software-specific Terms. Users may be required to review and expressly accept those Terms before accessing or activating the software. The publication of future software provisions in this document does not establish that the software has already launched or that users have accepted terms governing functionality they have not yet accessed.
